Article 1: Scope of application
These general conditions of sale apply to all transactions concluded through the websites belonging to Fizz and Flourish: My Creative Hub.
A “client” is considered any natural or legal person placing an order with Fizz and Flourish via our secure payment platform.
Article 1a: Age limit
Our products and services are intended for clients aged 16+ for digital and physical products, and 18+ for services such as coaching or workshops. Any client or subscriber who does not meet these criteria will be removed from our database and refunded if a purchase has been made.
Article 2: Order
Any order placed through a website belonging to Fizz and Flourish implies full and unconditional acceptance of these General Conditions of Sale.
Article 3: Price
Prices are indicated in GBP (£), inclusive of applicable UK taxes.
Prices may be changed at any time, however the price applied will be the one displayed at the moment of purchase.
Article 4: Payment
Payment is due immediately on the date of the order, including for pre-order products.
Payment is accepted by credit or debit card, PayPal and Apple Pay.
Secure online payment is processed through Stripe or PayPal. Data is encrypted during transmission. Any guarantee of payment security is the responsibility of Stripe or PayPal.
Article 5: Delivery of Digital Products
Access to digital products, including My Creative Hub, is delivered electronically to the email address provided during purchase.
The client is responsible for entering a valid email address. If access email links are not received, the client should contact support at info@fizzandflourish.com.
Article 6: Subscription Terms (My Creative Hub)
6.1 Nature of the Product
My Creative Hub is sold as an annual digital subscription that renews automatically every 12 months unless cancelled.
6.2 Billing & Renewal
The client will be charged the amount displayed on the order form (currently £297) at the time of purchase.
By purchasing, the client expressly authorises Fizz and Flourish to charge the same payment method automatically every 12 months until cancellation.
6.3 Price Changes
If the annual price changes, clients will be notified before their next renewal date. Price changes apply only to future billing cycles.
6.4 Cancellations
The client may cancel at any time.
Cancellation stops future billing but does not refund payments for the current annual period.
Access remains active until the end of the period already paid for.
6.5 Failed Payments
If a renewal payment fails, our system will retry. If retries fail, access may be paused or cancelled.
Article 7: Refunds & Guarantee
7.1 14-Day Money-Back Guarantee
Clients have the right to request a full refund within 14 days of purchase.
To request a refund, the client must email info@fizzandflourish.com within the 14-day period.
7.2 Non-Refundable After 14 Days
Due to the immediate access to digital content, templates, videos, and downloadable assets, all payments become non-refundable after the 14-day guarantee period, even if the client chooses not to use the product or cancels early.
Article 8: Protection of Personal Data
Fizz and Flourish complies with the UK GDPR and Data Protection Act 2018.
Clients may access or request deletion of their personal data at any time.
By entering an email address on any Fizz and Flourish website, the client agrees to receive newsletters and promotional emails.
Unsubscription is available via a link at the bottom of every email.
Article 9: Intellectual Property
All content, including templates, illustrations, systems, videos, downloads, and training materials, is the intellectual property of Fizz and Flourish.
The client receives a single personal licence and may not reproduce, share, resell, or distribute any materials.
Article 10: Applicable law
All clauses in these General Conditions of Sale are subject to the laws of Scotland and the United Kingdom.
In case of dispute, the applicable jurisdiction will be Scottish courts.
